Your Right to Know: Texas Now Requires Insurers to Explain Policy Declines, Cancellations & Non-Renewals

A declined insurance plan sign

A new law gives Texas homeowners and drivers critical information - and as your risk advisors, we help you act on it.

If you've ever received a letter saying your auto or home insurance was declined, canceled, or not renewed - and wondered why - you're not alone. For years, many Texans were left guessing. That changes now.

Thanks to House Bill 2067, a new Texas law requires insurance companies to tell you - in writing - exactly why they made an adverse decision on your policy. The law applies to decisions made after January 1, 2026.

What the Law Requires

Under HB 2067, if an insurance company declines to issue, cancels, or chooses not to renew your auto or home insurance policy, they must provide you with a written explanation of their reasons. No more vague notices. No more unanswered questions.

Later in 2026, insurers will also be required to submit reports to the Texas Department of Insurance (TDI) summarizing the reasons behind these decisions. TDI will aggregate and publish this data online, giving consumers and advisors like us a clearer picture of industry-wide trends.

Why This Matters for You

Knowledge is the first step toward taking control of your insurance situation. Here are two common scenarios where this law makes a real difference:

Home Insurance: If your home has prior damage that was never repaired, a roof issue, water damage, or structural concern - an insurer may choose not to renew your policy. Once you know that's the reason, you can prioritize those repairs and restore your home's insurability.

Auto Insurance: If you've had multiple at-fault accidents or traffic violations, a carrier may decline to renew your coverage. Knowing this gives you a clear picture of how your driving record is affecting your risk profile - and what you can do about it.

We Don't Just Find You a Quote - We Help You Manage Your Risk

At the Thumann Agency, we're not a comparison website. We're your risk advisors.

Anyone can pull up a list of prices online. What sets us apart is that we help you understand why you're being priced a certain way, why a carrier might see you as a higher risk, and - most importantly, what you can do about it.

If you receive a written explanation under HB 2067, bring it to us. We'll help you:

  • Interpret what the insurer's reasoning actually means for your risk profile

  • Identify actionable steps to improve your insurability

  • Find appropriate coverage in the meantime

  • Develop a long-term strategy to protect your home, your vehicles, and your financial future

What to Do If You Don't Receive a Written Explanation

If your insurer fails to provide a written explanation after declining, canceling, or non-renewing your policy after January 1, 2026, you have recourse. You can file a complaint directly with the Texas Department of Insurance (TDI) at www.tdi.texas.gov or by calling the TDI Help Line at 800-252-3439.
